    Tell me them that even though you are not from the same constituent, the Congressmen will be voting on these bills once tabled in the Congress and you are requesting to support the bill

    I called congressman Hinjosa's office.

    The staffer asked me where I am calling from. Then said you are not a constituent of the congressman and was not willing to transfer to the person who handles immigration issues. I insisted on leaving a message and he took the message, but was surprised, did anybody else encounter this? How do we handle this if it happens with other congressmen?

    There is a laundry list of things which are all good. Unfortunately I dont see anything realted to the ability to file 485 when priority date is not current.

    I guess it does not matter since this never passed. I can only hope that this does not become a trend and 485 measure is forgotten

    Appended to the Minimum wage bill was SA187 which amends SA112 sponsored by John Kerry and consponsored by Sununu, Snowe, Landrieu and Lieberman.

    Senate Amendment SA 187 seems to have passed with unanimous consent. This is what it apparently contains among a lot of other stuff... Please correct me if I am wrong.




    (b) Employment-Based Immigrants.--Section 201(d) of the Immigration and Nationality Act (8 U.S.C. 1151(d)) is amended to read as follows:

    ``(d) Worldwide Level of Employment-Based Immigrants.--The worldwide level of employment-based immigrants under this subsection for a fiscal year is equal to the sum of--

    ``(1) 290,000;

    ``(2) the difference between the maximum number of visas authorized to be issued under this subsection during the previous fiscal year and the number of visas issued during the previous fiscal year; and

    ``(3) the difference between--

    ``(A) the maximum number of visas authorized to be issued under this subsection during fiscal years 2001 through 2005 and the number of visa numbers issued under this subsection during those years; and

    ``(B) the number of visas described in subparagraph (A) that were issued after fiscal year 2005.''.


    Section 202(a) of the Immigration and Nationality Act (8 U.S.C. 1152(a)) is amended--

    (1) in paragraph (2)--

    (A) by striking ``, (4), and (5)'' and inserting ``and (4)''; and

    (B) by striking ``7 percent (in the case of a single foreign state) or 2 percent'' and inserting ``10 percent (in the case of a single foreign state) or 5 percent''; and

    (2) by striking paragraph (5).


    (b) Preference Allocation for Employment-Based Immigrants.--Section 203(b) of the Immigration and Nationality Act (8 U.S.C. 1153(b)) is amended--

    Honestly I don't even see a point for these discussions, polls or predictions for EB3-I. The sooner we accept we are doomed the better. The only way out is to help ourselves but I don't think many EB3's are willing to do that.
    I spoke to several in my office with earlier EB3 PD's (who might not even get GC's in the next 5-10 years !) and of course with EAD's and they have literally substituted EAD for a GC. They were once a part of IV (and some similar org's ?!) but now have completely lost hope and don't care. I tried to motivate them to join IV and support but they feel that IV does not cater to EB3's anymore. Sadly they are not even trying to port to EB2. They are just content with a job and EAD.
    So, I am not really sure how many of us are actually willing to fight ?!
    In fact it's even worse for people like me who are still waiting to file their I-485. Is it going to take us 5,10 or 20 years just to get an EAD ?!

    I agree, EB3 is doomed and I agree its better to accept the fact but dont agree that IV has forgotten EB3 (I can understand your pain).
    also as far as comprehensive Immigration reform is consodered...I would say whether anyone likes it or not. Its just for votes (fight is so as to who gets thec credit DEMs Or REPUBLICANS). I am againsit as it promotes giving amnesty to illegals.

    some assumptions and calculations with answer = 750k . You are right to get this 750K approved it will take 5 years.. more thing to consider is country level limitations. and EB1/2/3 limitations...ROW and China may already be catching up (may not even need 5 years)...India will need 50 years not 5 years to catch up.

    My 2 cents..

    Every one is here is emotional, after seeing the beautiful collective work of USCIS/DOS/DOL/AILA ect.. Now AILA is jumping high between sky and earth and due to the mismanagement of system. Everyone knows both USCIS/DOS is mismanaging the process. However, What AILA was doing when DOS issued the visa bulletin 15 days back? Do you thing, AILA did not know the estimate of number of 485s going to be filed in the month of July? Why did not they call USCIS and DOS about the implication of making all categories current? Why did they not advised their client that there is a mistake in VB, it is not possible it will become current in just one month? All of sudden, why they are jumping and collects all the money from customers to file 485?

    Here is my estimate how many 485s is going to be filed in July.

    BEC has almost cleared all the backlogs. The rough estimate about 200,000 LC might have been certified by BEC. Let�s assume about 150K out of 200K candidates held back due to retrogression from 2004 to 2007. Let us assume 150 K PERM LC certified between March 2005 and June 2007 affected by retrogression. Therefore about 300K (primary) people will go for 485 in July. If we add dependents it will be another 450K. Therefore about 750K 485s+ 750K AP + 600K EAD applications will be filed in the month of july.

    If 750K 485s filled in one month, we need about 5 years sum of EB visa numbers. It needs 5 years to issue the visa. There should be 750,000 EB visas should be immediately available as on July, to make all EB categories current. There are only 40,000 visas available as of June. Does AILA do not aware of this simple estimation?

    There are 40,000 eligible/approvable 485 are currently pending with USCIS. The composition of PD and country of chargeability may vary between 2001 and 2007. In order to issue 40,000 remaining visas to already pending 485s they made all categories current, otherwise it will get wasted. In order to approve a 485 the PD should be current. That�s why they made it current. It is not for accepting 750,000 485s, when available number is just 40,000. AILA should have aware of it and advised the USCIS/DOS and customers properly

    2. Recently how long does it take to get an H4 application approved (my appliction is processed in Texas Center)?

    i don't get it you are saying that members don't have to search...and yet someone has to keep it up on the home page...which is it? yes a sticky thread would have saved work and not required someone to keep it up. Why wasn't it done in the first place. When a service is supposed to be offered every should be offered every week...or else there should be an announcement that is will not be offered this particular week and that it will continue next on said week.

    No reason to be frustrated when people are asking simple questions...another idea would be to put the answers to the most frequently asked questions on the FAQ page...which does not work right that you don't have to repeat the answers.
    Its an easy solution i think.

    Any member who is willing to spend a few hours on a regular basis, please help us with a FAQ about the site. Some of the answers are already in the forums, you just have to put them under one umbrella. Please let me know who wants to work on this project - individual or group effort.

    Giving a long lecture of frustration is not the best way to attract people to an organisation.
    Think about u go buy clothes from a store that voices their frustrations about the prices of raw material...of do u go buy it because they were nice to you...had great customer service...nice selection of goods...and fair prices.

    I am sorry but working for hours on end alone, voicing frustration at lack of participation, treating members like they are morons for not being able to find supposedly simple things is a really terrible way to attract more people to an organisation. The cause may be noble...but who will wanna join some organisation where people just complain about how miserable things are.

    Please pause for a moment and think about what i am saying. This is exactly why you have less participation and less donation. IV needs to transform into a vibrant fun place to be while still upholding the noble cause.

    Let me be clear, the only way IV knows of treating its members is with RESPECT. If it was not with respect or the understanding of the struggles each of you go through - our motivation to continue this cause would have long disappeared.

    If there is frustration on our part, it exists within us, we hope for better, but the frustration (or anything else) has never stopped us from providing the service or executing the tasks.

    The "frustration lecture" as you call it was not meant to be a lecture - which goes to show that it is very difficult to control the tone and message on forums. Many people have questions, and since the topic came up, I shared some of my thoughts - to give members a peek of how things look from the inside.

    Not all our volunteering members are from DC area, they are as widely spread out as California, Minnasota, Florida, Texas, Mississippi, Tri State Area -- you name it, we have dedicated volunteers. Distance need not stop anyone from volunteering.

    I am not sure how much "hope" is selling for these days, let me know :) - Trying to make this a fun and entertaining forum :p

    Today is March 27, 2011. And I have 2 Tasks for interested members.

    1. Find a fourth lawyer to give advice for free for an entire hour - preferably on a Thursday.
    2. Help in compiling a FAQ, that will assist any new member to find his/her way through the forums.

    buddy...your quote kinda worries me. I can understand what you have gone through but always remember there are good things to life beyond worrying about this GC mess, following visa bulletins, and subsequent frustration/high bp/heart attack.

    I do what I can to educate the people around me about this legal immigration limbo and whatever within my control. I suggest you chill and use your energy positively to benefit yourself.

    At least dont kill fishes for fun. Don't you suffer pain of GC ? Think about pain of death. This pain is nothing compare to it..

    she is chairwoman for subcommittee on Immigration, Citizenship, Border Security and International Law.

    How much clout does this congresswoman have? She seems to understand the entire scenario better than any american soul out there! It also seems like she has spent a lot of time on this and understands the system very well.

    I guess it remains to be seen what kind of impact her letter will have on USCIS. Obviously, USCIS did something unlawful.

    i have no idea what ur talking about. i just looked at all the bulletins on the dos website and there was no question of retrogression till january 2005 when india and china
    retrogressed to jan 2002 for moved forward till june2005 (retrogressed to june2002) before it became unavailable.

    Finally retrogression as we know it hit on october 2005 where eb2 moved to 99 and eb3 to 98

    so where does "brief retrogression" in 2003 happen?

    ...I think a great deal depends on the person at the counter at InfoPass, or the one on the phone in case of NCSC.

    I took infopass this Monday at the local Chicago office. The guy basically said he cannot do anything...also said they cannot do anything even if I don't receive the card after 90 days. I then had an SR filed yesterday afternoon by calling this case the guy was nice and he even included my wife's EAD app info on the SR.

    FP: June 19th
    First card production ordered email: June 28th
    Second card production ordered email: July 29th

    I took infopass appoinment for August 1st.

    You will understand later my brother. After you get the GC when you look back. You will say to yourself "Wow, I was being so small and petty minded: I was bashing up real people for a piece of plastic". That is the time we can meet and be friends

    Value of a "person" will be known when he is gone. But the worthlessness of material thing gets realized when it actually comes. Character of a person is truly tested during trying times. May you reminisce about it later and wonder why didn't you do better

    On the same note guys..Nothing changes after GC.. I have always lived with this thought..If i want to go live back in India, I dont need a GC, If i decide to stay here in the US, It does not matter when GC long as u have legal status that you can maintain ( I know may not be for everybody ..esp who are in the clutches of the consultants)...most of you guys can change to job of your choice and maintain status..Without a GC, i have done everything you can do with one..( Job change, House buying , what else?)...So while i know it is a comforting feeling to have a GC, dont let that drive you crazy...the system is as fair or as unfair as it can be, it is how u look at it..Just chill ..good things will happen. Wishing you all the very best
